Terms of service
These Terms of Service govern your use of the Apex Visors website and your purchase of products from us. By accessing the store, placing an order or using our services, you agree to these terms together with the policies linked on the store.
Eligibility and acceptable use
You must be legally capable of entering into a binding contract in your location to place an order. You must not use the store for unlawful, fraudulent or abusive purposes; interfere with its operation or security; introduce harmful code; scrape or copy content without permission; impersonate another person; or infringe any person’s rights.
Product information and compatibility
We take reasonable care to display products accurately. Screen settings, lighting and the reflective nature of tinted and mirrored visors can cause colours to appear different in person. Images may be illustrative of finish and colour.
You are responsible for checking the exact helmet brand, model, generation, shell or visor mechanism stated on the product page before ordering. Similar model names do not necessarily use the same visor. Contact us before purchase if compatibility is uncertain.
References to helmet manufacturers or model names identify intended compatibility only. Unless expressly stated, Apex Visors products are aftermarket products and are not represented as manufactured, sponsored or endorsed by the helmet manufacturer.
Safety and lawful use
Motorcycle visor tint, visible-light transmission, certification and permitted time of use vary by country, state and territory. Before use, you are responsible for checking all laws, standards and licensing requirements that apply where you ride.
Do not use a tinted or mirrored visor at night, in poor visibility or in any conditions where it would impair safe vision, unless the product is expressly approved for those conditions under applicable law. Follow the helmet manufacturer’s fitting instructions, ensure the visor locks and operates correctly, and inspect it before every ride. Do not use a cracked, deeply scratched, damaged, incorrectly fitted or vision-obstructing visor.
Nothing in this section excludes liability or obligations that cannot lawfully be excluded.
Orders and acceptance
Submitting an order is an offer to purchase. An order is accepted when we send confirmation that it has been accepted or dispatched. An automated acknowledgement does not necessarily mean an order has been accepted.
We may refuse or cancel an order before dispatch where reasonably necessary, including for unavailable stock, an obvious pricing or description error, suspected fraud, payment failure, delivery restrictions or breach of these terms. If payment has been taken for a cancelled order, it will be refunded.
Prices, taxes and payment
Prices are displayed in the currency shown on the store. For Australian consumers, displayed prices include GST where applicable. International taxes, import duties and fees may be charged separately by the destination country unless checkout expressly states they are included.
Prices and promotions may change without notice, but a change will not affect an accepted order except where correcting an obvious error as permitted by law. You authorise our payment providers to charge the payment method selected at checkout.
Availability and purchase limits
Products are subject to availability. We may limit quantities where reasonably necessary to prevent fraud, unauthorised resale or stock errors. If an item becomes unavailable after ordering, we will contact you and provide an appropriate refund or alternative choice.
Shipping, returns and refunds
Our Shipping Policy and Return and Refund Policy form part of these terms. Delivery dates are estimates unless we expressly agree otherwise. Your mandatory consumer rights are not limited by those policies.
Accounts and information accuracy
If accounts are enabled, you are responsible for keeping login details secure and for activity under your account. You agree to provide current, accurate and complete order, payment and contact information. Notify us promptly of unauthorised account use or an error in your details.
Intellectual property
The store and its original content—including Apex Visors branding, graphics, photography, text, product presentation, layout and code—are owned by or licensed to Apex Visors and are protected by applicable intellectual-property laws. You may use the store only for personal shopping and other lawful, non-commercial purposes. No rights are transferred to you except as expressly stated.
Reviews and submitted content
If you submit a review, photograph, comment or other content, you confirm you have the right to submit it and that it is accurate, lawful and not misleading or infringing. You grant Apex Visors a non-exclusive, worldwide, royalty-free licence to host, reproduce, adapt and display that content for store operation and promotion, subject to applicable privacy law. We may moderate or remove unlawful, abusive, irrelevant or misleading content.
Third-party services and links
The store may use or link to third-party services. We are not responsible for independent third-party websites or services that we do not control. Their own terms and privacy policies apply. This does not affect any responsibility we have under applicable law for service providers acting on our behalf.
Consumer guarantees and disclaimers
Nothing in these terms excludes, restricts or modifies any guarantee, condition, warranty, right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law.
To the maximum extent permitted by law, the website and any non-excludable-free services are provided on an “as available” basis. We do not guarantee uninterrupted access or that every website error will be corrected immediately.
Limitation of liability
To the maximum extent permitted by law, Apex Visors will not be liable for indirect or consequential loss that was not reasonably foreseeable, or for loss caused by misuse, unlawful use, incorrect installation, an incompatible helmet, unauthorised modification, failure to follow safety instructions or events outside our reasonable control.
Where liability can lawfully be limited, our liability will be limited to the remedies permitted by applicable law. This clause does not limit liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any other liability that cannot legally be limited.
Indemnity
To the extent permitted by law, you agree to indemnify Apex Visors against third-party claims and reasonable costs arising from your unlawful misuse of the store, infringement of another person’s rights or material breach of these terms. This clause does not apply to the extent a claim was caused by Apex Visors or where an indemnity is prohibited by law.
Suspension and termination
We may suspend or terminate access to the store where reasonably necessary to protect customers, the store or third parties, or in response to a material breach of these terms. Provisions intended to survive termination will continue to apply.
Governing law
These terms are governed by the laws applicable in Australia. You and Apex Visors submit to the courts and tribunals with jurisdiction in Australia, without limiting any mandatory rights you have under the laws of your place of residence.
Severability, waiver and entire agreement
If any provision is invalid or unenforceable, it will be read down or severed to the minimum extent necessary, and the remaining provisions will continue. A delay in enforcing a right is not a waiver. These terms and the policies incorporated into them form the agreement governing use of the store and purchases from us.
Changes
We may update these terms from time to time. The current version will be posted on this page with a revised date. Changes apply prospectively except where otherwise required by law.
